A joint bank account is a wealth management tool widely used by couples to facilitate the management of their financial resources. However, its operation raises numerous legal questions when considered in light of the various matrimonial property regimes provided for under Congolese law. Indeed, determining ownership of the funds, the powers of each account holder to dispose of the funds, as well as the consequences of divorce, death, or legal action brought by creditors highlight the limitations of the current legal framework.This book offers an in-depth analysis of the interactions between joint bank accounts and matrimonial property regimes under Congolese law. Through an examination of national legislation, legal doctrine, and relevant case law, it highlights the issues related to the protection of spousal assets, the security of banking transactions, and the rights of third parties. Finally, the author makes recommendations aimed at strengthening legal certainty and promoting better coordination between banking law and family law in the Democratic Republic of the Congo.
